Refund & Cancellation Policy

This Refund & Cancellation Policy (“Policy”) governs the terms under which refunds and cancellations will be administered for the services provided by VAARTA AILABS PRIVATE LIMITED (“Company,” “we,” “our,” or “us”) through the platform vaarta.ai. By subscribing to or using our services, the customer (“you,” “your,” or “User”) agrees to the terms set out in this Policy.
1. Trial Period
- 1.1 Certain services offered by the Company may include a free trial period.
- 1.2 During the trial period, no fees are charged, and therefore refunds are not applicable.
- 1.3 If you do not wish to continue with the service, you may cancel at any time during the trial without incurring charges.
2. Cancellation of Paid Subscriptions
- 2.1 You may cancel your paid subscription at any time by providing written notice to support@vaarta.ai.
- 2.2 Upon cancellation, your account will remain active until the end of the then-current billing cycle, unless otherwise specified in writing.
- 2.3 No partial month or partial term cancellations will be refunded unless expressly provided for under Section 3 of this Policy.
3. Refunds for Paid Subscriptions
- 3.1 Refunds are available only to paid subscribers and not during any free trial.
- 3.2 If you cancel your subscription after the trial period, you will be charged on a pro-rata basis for the actual usage and consumption of services up to the date of cancellation.
- 3.3 After verification of consumption, any refundable amount will be processed within thirty (30) days of receipt of the cancellation request.
- 3.4 All refunds will be credited to the original payment method used at the time of purchase.
4. Refund Exceptions
Refunds will not be issued under the following circumstances, which are deemed non-refundable scenarios:
4.1 Third-Party Platform Policy Violations
- If your WhatsApp Business Account or phone number is blocked, suspended, or restricted by Meta due to violations of Meta’s policies (including but not limited to spam, prohibited content, or misleading communication).
- If your email domain is blocked, suspended, or blacklisted by an email service provider due to policy violations, spam complaints, or misuse.
- If your SMS, IVR, or telecommunication services are blocked or restricted by telecom operators due to misleading, fraudulent, or non-compliant content.
4.2 Governmental or Regulatory Restrictions
- If services are suspended, restricted, or terminated due to government regulations, compliance requirements, or legal restrictions.
- This includes but is not limited to cases involving gambling, phishing, fraudulent communication, misleading advertisements, spam campaigns, or any activity prohibited under applicable laws.
4.3 Breach of Terms of Service or Misuse of Services
- If your account is terminated or suspended due to a violation of our Terms of Service or misuse of services.
- Misuse includes, but is not limited to, bulk spamming, impersonation, fraudulent campaigns, distribution of misleading information, or creation of fake IVR systems.
4.4 Promotional and Non-Refundable Fees
- One-time setup fees, discounted promotional plans, and add-on credits are strictly non-refundable.
4.5 Partially Used Subscriptions
- Refunds will not be provided for partially used subscription periods, except in cases where prorated refunds are explicitly permitted under Section 3.
5. Auto-Renewal and Billing
- 5.1 All paid subscriptions are subject to automatic renewal unless canceled prior to the renewal date.
- 5.2 If you are charged due to automatic renewal and wish to cancel, a refund request must be raised within seven (7) days of the renewal date.
- 5.3 Beyond this seven-day window, no refunds shall be issued for auto-renewal charges.
6. Refund Processing Timeline
- 6.1 Once approved, refunds will be processed within thirty (30) days from the date of confirmation by the Company.
- 6.2 The actual crediting of funds may be subject to delays outside the Company’s control, including but not limited to delays by banks, payment gateways, or financial institutions.
7. Limitation of Liability
- 7.1 The Company shall not be liable for any indirect, incidental, or consequential damages arising out of or in connection with cancellations, refunds, or denial of refunds under this Policy.
- 7.2 The maximum liability of the Company in connection with any refund claim shall be limited to the amount actually paid by the User for the relevant subscription period.
8. Governing Law and Jurisdiction
- 8.1 This Policy shall be governed by and construed in accordance with the laws of India.
- 8.2 Any disputes arising out of or relating to this Policy shall be subject to the exclusive jurisdiction of the courts of Jaipur, Rajasthan, India.
